These terms are a contract between you (the business that opens a Kwita account, and each person who uses it) and Nowtek (Pty) Ltd, registration 2016/522945/07 (Nowtek). By using Kwita you agree to them. If you are signing up for a company you confirm you may bind it.
1. The service
Kwita is online software for quotes, invoices, expenses, banking, inventory, point of sale, customers, payroll, projects, accounts and VAT reporting, with sending and receiving over WhatsApp. We may add, change or retire features. We will give at least 30 days notice before removing a feature that you pay for.
2. Your account

- You must be 18 or older and use Kwita for business purposes.
- Tell us at once if you think someone else has access.
3. Trial, plans and payment
- New accounts get a 14 day free trial on the Grow plan. No card is needed. At the end of the trial you choose a plan or the account becomes read only.
- Plans and add-ons are priced in Rand, VAT included, as shown on the pricing page on the day you subscribe. Monthly plans renew every month. Annual plans renew every 12 months and are not refundable after the first 14 days.
- We may change prices with 30 days notice by email. The change applies from your next renewal.
- If a payment fails we will try again and email you. After 14 days without payment the account becomes read only. After 90 days we may close it, subject to the record keeping in section 7.
- Cancel at any time from Settings. Access continues until the end of the paid period.
4. Your data
- You own the data you put into Kwita. We get only the rights needed to run the service for you.
- You are the responsible party under POPIA for personal information about your customers, suppliers and staff. You must have a lawful basis to hold it and to message them. See our privacy policy and POPIA notice.

- Receipt reading and bank matching are aids. You approve every entry before it posts to the ledger.
7. Record keeping
South African law requires financial records to be kept for 5 years. While your account is open we keep them for you. After closure we keep financial records for the rest of that 5 year period unless you export them and ask us in writing to delete them earlier, in which case you take over the duty to keep them.

Our total liability to you in any 12 months is limited to the fees you paid us in that period. Nothing in these terms limits liability that cannot be limited under the Consumer Protection Act or other law.
